Legal Observers NSW has observed a prevalent misuse of the Form 1 system by the NSW police over the last 2 years. This has resulted in a disturbing power overreach that is inconsistent with the provisions in the Summary Offences Act 1988. Misrepresentation of the notification of public assembly requirements has been utilised as a means to deny the right to protest, as has micromanagement of protest conditions.
